警涉包庇賭博業 檢抗告成功

台北市、新北市警局疑似因為包庇賭博電玩店，檢調上週再次發動偵查作為，約談記者、員警、股東後聲請羈押禁見，法院最後只裁定收押員警、股東共四名被告，至於兩名涉案記者獲得無保釋放。檢方不服向高院提出抗告。台灣高等法院今天做出最新裁定，將原裁有關於股東李俊諺、記者許聲胤、黃其豪的部分撤銷發回台北地院。

高院在撤銷理由中指出，原審對於很多犯罪事實的細節都沒有考慮清楚，其中，法院只認定李俊諺觸犯「聚眾賭博罪」諭知羈押，但對於李俊諺是否涉及行賄的部分，完全沒有多加審酌，此外，法院又以許聲胤、黃其豪的犯案時間點在當時無法可罰，裁定無保釋放也有問題，另外，高院也認為三名被告的犯罪嫌疑重大、有逃亡、湮滅、偽造、變造證據或勾串共犯或證人的可能，所以撤銷原裁定發回北院重新召開羈押庭。
