酒駕拒測捕破網　今晚罰9萬加強制抽血

【林志青╱台北報導】針對近來民眾躲避刑責拒絕警方酒測，警政署表示，已訂定執法程序，並通令全國警察機關執行，遏阻部分民眾僥倖心態。
 
警政署指出，依《道路交通管理處罰條例》規定，如民眾經警員完成告知程序仍拒測，處9萬元罰鍰，吊銷駕照3年，並當場扣車；若眾出現語無倫次或其他異常行為等，依《刑事訴訟法》第88條及第205條之2規定，將其逮捕並強制抽血酒測。
 
警政署表示，如民眾仍拒，警員可依《刑事訴訟法》第205條之1第1項規定，報請檢察官聲請鑑定許可書，核可後，將民眾送醫療或檢驗機構採取血液鑑定，依《刑法》第185條之3公共危險罪嫌移送地檢署偵辦。
