隨機拍照片遭冒用　法官：無原創性

【許淑惠／台中報導】中市陳姓男子2010年底在露天拍賣網站上販賣「MiNi DV行車紀錄器」，使用2張行車紀錄器安裝在車上的實景照片做為型錄介紹，前年8月，林姓男子上網發現陳男使用的照片是他拍的，控告陳男違反《著作權法》。
 
台中地院審理時，林男表示他是通訊科技公司負責人，當時拿到這商品時，朋友的車剛好放在店門前，就跟朋友借車裝上，用一般的數位相機拍照，要呈現商品屬微型錄影器，可以吸附在車上當行車錄影。

法官認為林男只是隨機拍照，沒有具體表現出作者的獨立思想或感情，欠缺攝影著作所需具備的原創性，無法受到著作權的保護，判陳男無罪。
