林于如釋憲求活 法官不受理

〔自由時報記者項程鎮／台北報導〕驚世媳婦林于如為詐領保險金，8個月內連殺母親、婆婆和丈夫，被判死刑定讞，她為了求活，日前聲請釋憲，自認有心智障礙不該判死；司法院大法官會議昨決議「不受理」她的釋憲案，林于如仍難逃一死。

林于如表示，她有精神障礙，最高法院不應適用刑法第19條的「精神障礙條款」將她處極刑。大法官認為，最高法院並未依刑法第19條作為判死理由，林引用錯誤法條聲請釋憲，因此從程序上駁回。

林的律師曾主張她智商只有57；但夫家親戚指她積極接掌家族事業，店家都稱她「總裁」，她還簽六合彩，擬定殺人計畫，沒有智能障礙。
