男信教丟母13尊佛像　毀損起訴

陳姓男子（54歲）與7旬老母同住，4年前母親因老人癡呆症，由家人向法院聲請宣告監護，並由陳某的姊姊擔任監護人。詎料陳近年成為基督徒後，遵行不能祭拜偶像的教條，今年1月16日竟將母親在家中安置多年的觀音佛、三寶佛、釋迦佛等13個大小佛像以及祖宗牌位等全數丟棄。姊姊知悉後，怒告弟弟毀損。

陳辯解只有請人搬走，沒毀損，且事先有經過母親同意，有看護作證。看護證稱，當時母親回答的是：「隨你啦，我已經生病，無法作主。」檢察官認為，這句話只能說母親表達身體健康不好，但沒有明示或默示陳可以處理掉佛物，且陳也沒有經得監護人或是陳父同意，擅自遣人搬走佛物，依毀損器物罪起訴陳。
