書記官搞烏龍　法院判決變變變

【王文傑／花蓮報導】花蓮1名經營酒廠的劉姓業者因出產的小米酒商標遭人侵害，2年前通報智慧財產局保智大隊逮到兩名陳姓業者涉嫌侵害商標，仿冒的業者去年遭檢方起訴並求刑2年。但判決後的48小時內卻發出兩判決主文公告，不僅有罪改判無罪，連公告內容都只改「半套」變成無罪判決，卻是有罪敘述的離譜內容。
 
花蓮地方法院書記官長李明正表示，全案原本於去年7月要宣判，承審法官當時曾告知劉姓書記官判決結果，但法官隔天覺得仍有再審空間，也囑咐書記官前次判決作廢，從7月至12月開過2次辯論庭讓雙方陳述，才於去年12月30日改判無罪。不料，該名劉姓書記官全忘了，先拿7月的有罪判決主文刊登上網，隔天發現疏失，再將主文公告改成無罪，但出於疏忽又沒刪除有罪的內容敘述。
