消費者若是發現商品有錯誤或瑕疵，欲主張撤銷買賣契約，則業者「概不退貨」規定違反誠信原則，是不公平條款，約定無效，消費者可要求退貨還錢。

如買受人已受
領者，得返還有瑕疵之物而請求更換。惟出賣人因買受人之請求同意另交
付無瑕疵之物時，買受人之選擇因已確定不得撤回，而同時喪失其他瑕疵
擔保請求權。
