指陳菊弟圍標　邱毅林瑞圖分判1年與10月徒刑

高雄市長陳菊的弟弟陳武進控告前立委邱毅和台北市議員林瑞圖指他涉嫌工程圍標，高雄地方法院審理終結，依誹謗罪判處邱毅一年、林瑞圖十個月有期徒刑，全案還可以上訴。

高雄地方法院在判決書中指出，去年檢調偵辦前行政院秘書長林益世案期間，前立委邱毅和台北市議員林瑞圖在政論節目當中，指高雄市長陳菊的弟弟陳武進「操控南部公共工程圍標」以及介入高雄市政府環保局對地勇公司斷料令。陳武進因此提自訴，控告邱毅和林瑞圖涉嫌妨害名譽，高雄地院審理時，邱毅和林瑞圖都否認有涉及誹謗犯行，並要求法院調閱林益世案偵查資料，證明不是無的放矢。

高雄地方法院審理終結，依陳武進提供的電視側錄蒐證影帶，認定邱毅和林瑞圖多次在媒體上散布不實言論，已經毀損陳武進名譽，分別依11個誹謗罪判處邱毅有期徒刑1年，林瑞圖依8個誹謗罪判處10個月，得易科罰金，全案可以再上訴。
