大師的回答很棒很清楚。

不過對於羈押權收回我基本上是持中立立場。

就刑事追訴的方便及效率來看給檢察官羈押權是頗方便。

但是沒有人限制羈押權的行使也是會有問題的。

然而現行實務上法官通常都不會給檢察官難看，大體上都會同意檢察官的聲請。

最後關於Due process我個人還是認為很重要。

但也無可反駁收回羈押權是因為檢察官惹到高層......
