毒犯二審翻供 法官加重刑期

台東呂姓男子去年5月遭警查獲持有安非他命，簡易庭時他坦承犯案，法官判處他拘役50日；檢方上訴，呂男改口，否認持毒，法官以「犯後態度不佳」，加重判處他有期徒刑2月，不得上訴。

去年5月間，呂姓男子在澎湖縣購得安非他命，返台東途經森永安檢所遭警方查獲，移送法辦。

台東地院簡易庭法官以他持有毒品數量尚微，且「犯後態度良好」，輕判拘役50日，可易科罰金；檢察官認為法官判太輕，向台東地方法院提出上訴。

再次開庭呂男直接翻供，向法官供稱不知毒品來源「可能是10幾年前放的，自己10幾年沒有碰毒品，不知毒品怎會在車上」。

法官最後認定呂犯後不知悔悟，藉詞狡辯，加重刑期10天，判處有期徒刑2月，可易罰金。
