反韓言論 日本法院裁定違法

針對日本右翼團體「不允許在日特權市民會」(簡稱「在特會」)的反韓言論，京都地方法庭今天(7日)裁定，這個團體必須支付1,200萬日圓(相當於12萬美元)，以賠償他們在京都一所韓國小學外面舉行「仇恨演說」的集會，干擾上課並驚嚇兒童。

人權專家表示，這項具有里程碑意義的裁定，首度承認，遊行活動中使用的特定侮辱詞句，已經構成種族歧視；因此，能夠激勵一項行動，將仇恨言論排除在憲法保障的言論自由之外。

京都地方法院法官表示，反韓團體在特會以及他們的支持者，在韓國小學外面的集會中，所高聲叫囂的仇恨語言，以及所寫的標語，都是違法的，並且干擾上課、驚嚇兒童，已經構成聯合國「消除各種形式種族歧視國際公約(Internationl Convention on the Elimination of all Forms of Racial Discrimination)」所定義的種族歧視罪。日本是這項公約的簽署國。

這所南韓小學在2010年的6月，控告在特會和8名活動人士，於2009年12月到2010年3月之間，在他們學校外面舉行3次類似的集會活動。由於這些份子威脅韓國人，還叫囂辱罵，導致若干學童出現胃痛的毛病。
