塑毒72小時會排出體內　團體訴訟挫敗主因

【孫友廉／新北地院】5百多名民眾針對塑化劑提起團體訴訟求償24億餘元，其中大部分求償金額都是精神慰撫金，卻遭法院駁回，新北地院指出，未判賠精神慰撫金，主要是考量行政院衛生福利部國民健康署的《食品中塑化劑污染衛教手冊》，指塑化劑DEHP、DINP等會在短期間內經人體代謝排出，對於健康並未造成損害。
 
該手冊指出，雖塑化劑DEHP、DINP進入人體有致癌性，生殖毒性，但須長期攝取超過每日可容忍攝取量，才會影響人體健康。其次，縱使長期攝食超量，但仍會受劑量多寡、暴露長短，暴露途徑等因素影響，且塑化劑進入人體後12至24小時，約一半會由尿液或糞便排出，72小時內均會被排出體外。
 
至於有消費者求償醫藥費、減少勞動能力及增加生活上需用費用，也因消費者無法證明有實際損害，均未判准。故僅判賠消費者購買統一、名牌等18家業者商品的花費共120萬餘元。
