陳豐義毀監院檔案 北檢要查

監察院祕書長陳豐義因擅自銷毀上千件公文檔案，遭監察院彈劾；台北地檢署也根據檢舉，就陳豐義是否違反檔案法，簽分「他」字案，指派檢肅黑金專組主任檢察官偵辦。據了解，檢方近日將傳喚陳豐義等相關監院官員說明，釐清銷毀檔案過程是否構成犯罪。

監委認為，陳豐義一百年六月指示辦理「監察院調查案件檔卷清理計畫」，就監察院已歸檔的未逾保存年限，以及需要永久保存的調查案與行政案卷，逕自抽取部分內容銷毀，總計有一六五四件檔案「無從查考」，陳擅自銷毀高達一六一．五公尺，相當於新光大樓高的檔案，嚴重違反檔案法，而被監察院彈劾，並將陳移送公懲會懲戒。但陳豐義否認，強調絕無不法。

台北地檢署日前接獲民眾檢舉，指控陳豐義擅自銷毀作法，明顯已經違反檔案法，除了行政責任外，檢方亦應主動追究陳的刑事責任。

檢舉指稱，檔案法第十二條規定，定期保存之檔案未逾法定保存年限或未依法定程序，不得銷毀。檔案法亦規定，明知不應銷毀而銷毀或違反法定程序，處二年以下有期徒刑、拘役或科或併科五萬元以下罰金。
