法務部：假釋不受影響

軍事審判法修正案今天生效，大批軍事犯移送十一處法務部所屬監獄。法務部說，家屬可辦理接見，假釋等處遇措施不受影響。

法務部下午召開記者會，政務次長陳明堂表示，受刑人原本在軍監執行的累計處遇分數都納入計算，仍依原級別辦理各項處遇措施、假釋都不受影響，受刑人若屬全民健康保險相關納保對象，仍會依健保身分就醫，就醫權利不受影響。

至於配房問題，陳明堂說，依收容人身心狀況、刑期、罪名等分配舍房，原則上不會獨居，考核一周到二周後，就可下工場參加一般作業。

媒體詢問，前海軍上校郭力恆等高階軍官為何集中移往台北監獄？陳明堂表示，雖然考量囚情穩定、超收狀況，將多數軍事犯移往中南部監獄。但因郭力恆等人階級較高、且有軍事機密敏感案件在身，審酌北監收容特殊階級受刑人的經驗豐富，為便於管理而集中北監。

媒體詢問，郭力恆服刑近廿年，何時可假釋？陳明堂表示，由台北監獄假釋審議委員會處理，法務部對個案不臆測。媒體質疑，前憲兵司令何雍堅中將移監時疑似未上戒具。陳明堂指出，尊重國防部作為。

軍審修法新制上路後，軍審案件分兩階段移交司法系統，包括陸海空軍刑法凌虐部屬、違法懲罰等罪，在新法生效後立即移交；至於其他軍法案件，預計新法公布五月內再陸續移轉。
