大埔案爭辯公益 法官：已了解

苗栗大埔案有28戶控告內政部的區段徵收案違法，台中高等行政法院昨開庭審理，農民委任律師李明芝提出日前拒拆戶張藥房老闆張森文之死為例，希望法官的裁定能還死者公道，法官最後裁定，下個月再審理此案並進行辯論庭，擇期宣布裁定結果。

昨天下午是準備庭，法官讓內政部、苗栗縣政府代表人員和農民委任律師充分表達意見，雙方在法庭上激辯，更在大埔開發案的「公益性和必要性」內容爭論，官方代表說開發案都有評估公益性和必要性「不言自明」，農民委任律師反擊「空口無憑」，最後由法官勸阻雙方說「不必在公益性和必要性上辯論，我已了解」。
