60歲男想傳宗接代　1年行房40次嫌少訴離婚被駁

一名年近60歲的男子，日前向法院提告，自己和大陸籍的妻子因為性生活不協調，怒控妻子不太願意發生性關係，讓他無法傳宗接代。但法院審酌後，認為男子在婚後1年就和妻子行房至少超過40次，以他的年紀不算少，因此駁回男子的離婚請求。

這名年近60歲的呂姓男子，他控訴和大陸籍妻子在95年2月婚後，到96年8月之間，僅發生40多次的性關係。但之後妻子不太願意和他行房，他認為2人緣分已盡，不願再和妻子發生性關係。當時他曾提出離婚，妻子也允諾卻一再反悔，甚至還屢次要求50萬至2000萬不等的錢。

2人的離婚官司拖延5、6年，呂男曾3度向法院訴請離婚卻都遭駁回，隨著年紀增長快接近60歲了，認為自己如果不能離婚再娶，就無法傳宗接代，因此今年又提出離婚訴訟，希望法官判離。但根據《中國時報》報導，台中高分院認為，以當時呂男年紀，平均每12天就和妻子發生性行為，每次約3次並不算少，加上是呂男自己不再與妻子發生關係，無法傳宗接代的責任在於他，因此駁回請求。
