酒駕汽車迴轉撞上直型機車

我於2013年10月30日發生車禍
地點:市民大道京站轉運站出口

我於市民大道往河堤方向走經過轉運站出口都會看有無車輛要迴轉(因那計程車多)
就在我看過兩邊都無車輛要過 要往前騎時突然左邊迴轉到有輛計程車衝出
我便反應不及撞上他右邊車頭燈
我人就彈出摔在地面 當下有叫警察 對方酒測值為0.37
我也隨後送往醫院 發現腳跟肩胛骨都有骨裂

說這麼多我想請問各位大哥大姊
這種情況屬於誰路權較大? {當時車速50~60 對方也不慢不知道多少}

我可以跟他要求什麼賠償?
哪些保險?
如最後上法院 我告他過失傷害 他會被罰錢嗎?

麻煩各位大大替我解惑....
