行車生糾紛輾斃騎士　油漆工判刑3年6月

【潘岳／宜蘭報導】宜蘭1名33歲黃姓油漆工，7個多月前，凌晨開車外出吃宵夜途中，不爽吳姓機車騎士按喇叭超車，也按喇叭回嗆，2人進而爆發口角衝突，黃男突抓狂，一路追逐吳男，並在一處巷弄內將吳男撞倒，致吳男當場慘死。
 
宜蘭地院調閱路口監視器錄影帶認為黃男追逐吳男10餘分鐘過程，均緊跟在吳男車後追，並無加速追撞之惡行，法醫相驗報告也認為，根據吳男傷勢，研判吳男係因遭汽車追撞拖地，致傷重不治；法官據此，採信黃男並無置吳男於死說詞，改以傷害致死罪論刑，但法官見黃男無前科記錄，且已於被害人家屬達成380萬元民事賠償和解，並已給付250萬元，最後判處3年6月徒刑。
