2010年1月21日，最高行政法院駁回環保署上訴，撤銷中科三期（中部科學園區第三期七星基地開發案）環評審查結論。然而，環保署未依司法判決命中科停工，官方新聞稿指出中科三期不違環評法第14條與第22條之精神，署長沈世宏亦抨擊法院無權詮釋環評法。2010年2月4日，后里農民北上行政院、監察院與環保署陳情，直指環保署傾向財團，惡意曲解法令，訴求中科管理局、國科會以及環保署依法立即停工。
