實習醫學生不適用勞基法 監院糾正

監院20日表示，行政院勞委會及衛福部對住院醫師納入勞基法雖有共識，卻未能積極處理工時問題，使時程一再延宕；勞委會與教育部忽視實習醫學生實際「從事工作、領有報酬」，至今認定不適用勞基法及勞保條例，未能保障實習醫學生權益，監察院財經委員會通過糾正勞委會、衛福部、教育部。

監察委員尹祚芊、李復甸提案表示，勞委會與教育部認定實習醫學生不適用勞基法及勞保條例，認為他們在醫師指導下實習，非從事工作；或認為培養專業醫師，與技術生訓練這種培養「基層技術人力」的精神差距甚大，忽視他們實際「從事工作、領有報酬」，未能適當保障他們的權益與身心安全，有違失。
