賣屋簽約後反悔　判付全額仲介費

【劉昌松／台北報導】台北市顏姓婦人前年委託永慶房屋以1億2千萬元出售名下不動產，最後以9千多萬元簽約售出，但顏婦在簽約後隔天就反悔，並拒絕支付永慶房屋仲介費，最高法院認定簽約已完成，即使最後沒成交，顏婦也應付仲介費用367萬元定讞。

顏婦主張，委賣契約載明仲介服務費應為賣價的2%，且當初曾和買家達成協議不賣屋了，房仲不應要她支付這麼高的仲介費用。

但高院認為，仲介委賣契約上的2%仲介費欄未被勾選，反而是賣家和永慶房屋另外簽了一份367萬元的服務費確認單，而這個金額並未超過「不動產仲介經紀業報酬規定」中，房屋價金6%的標準，既然永慶房屋事實上已經成功仲介買賣，並由買賣雙方簽約，顏婦就應支付約定的服務費，判她敗訴定讞。
