證人轉被告？　顧立雄：總統主觀犯意難判斷

【張麗娜／台北報導】台北地檢署偵辦檢察總長黃世銘洩密案，昨傳喚總統馬英九、行政院長江宜樺出庭作證，有意參選台北市長的知名律師顧立雄上午接受周玉蔻節目專訪後，媒體提問馬英九是否可能從證人轉為被告？顧立雄說，到現在為止，馬還是證人身分；就洩密部分，應該還是檢察總長的責任比較大，因為這是總長來跟總統報告，而總統要如何回應，確實有其難為之處，換成任何一個人，當下要做什麼處置，確實是難為的，因此就刑事責任而言，就總統的主觀犯意還很難說會有。

不過，顧立雄也說，這件事情透露出他的政治判斷與諮詢法律面人才的缺乏，現在看起來好像就是他們幾個人就決定了，這幾個人除了馬英九外，好像沒有人念法律的，就算馬是念法律的，就這部分的法律可能也非他所擅長，他只是很訝異說，一個總統的資源居然是如此匱乏。
