警侵佔遺失物丟職　判1年6個月緩刑3年

【林泊志／宜蘭報導】羅東警分局公正派出所前警員莊志欽，因涉入司法黃牛案，今年4月間遭檢調搜索，不料在莊男抽屜內，起出1批遺失物，追問來源才發現他竟侵佔大批遺失物，部分遺失物還拿去典當變現，前後共得手約2萬6千元，部分金飾、玉飾帶回自己家中。訊後莊員丟職遭檢方起訴。宜蘭地方法院審理後，依侵占職務上持有之非公用私有財物，判他有期徒刑1年6月，緩刑3年，褫奪公權3年，其犯罪所得財物分別發還原所有人。
 
承審法官認為，因其擔任警員職務竟不循法令，因一時經濟困窘，侵占私有財物，危害公務員形象，破壞法律秩序，本應嚴懲。但莊犯後坦認犯行與被害人和解、賠償，於案發後辭去警員職務，最後遭判有期徒刑1年6月，緩刑3年，褫奪公權3年。
