鑰匙相似誤騎他人車　失智男獲不起訴

【林泊志／宜蘭報導】宜縣壯圍鄉一名男子余阿井（70歲），今年8月在宜蘭市南館市場買完東西後騎車返家，其子發覺車牌不同，懷疑罹患失智症的爸爸騎錯車，趕緊把機車騎到派出所，盼能歸還車主，但警方竟以竊盜罪將余翁送辦。宜蘭地檢署今天偵結，因機車車型、外觀類似，且鑰匙孔能相通，認為余並無竊盜犯意，處分不起訴。
 
處分書引最高法院判例指出，要構成《刑法》竊盜罪，須意圖為自己或第三人不法之所有，而取他人所有物，若行為人因誤信該物為自己所有而取得之，即欠缺意思要件，無法認定構成《刑法》竊盜罪。
