“走私”可以是過失犯罪嗎？

若以台灣的法條   

過失的定義   應為因注意而未注意

板大相信走私    有可能如此嗎?

在對岸不知道相關須申報    會以逃漏稅相關法規去認定

但罰了一次   還說不知道    就會被視為故意

所以第一次   通常不會那麼嚴重

在台灣的法律輕重   本來與對岸不同

光以所謂的詐欺罪

台灣不管再嚴重   最多只有五年

對岸   最輕五年   最重不排除死刑

所以   請不要拿台灣的法條輕重與對岸比

那可不成比例

若相關狀況在台灣   不算走私

懲治走私條例   有對相關物品做明文規定

但相關狀況應違法化妝品衛生管理條例

看相關化妝品   是哪種狀況

會依該條例第27.28條相關處理
