收繳不法所得 需地方中央聯手

衛生福利部下重手，對食用油摻偽假冒的大統、富味鄉，分別建議地方衛生局開罰18.5億、4.6億元。不過面對史上最高的天價罰款，業者可能會提出訴願、走行政訴訟等程序自保，彰化縣衛生局長葉彥伯表示，到時可能需要中央協助，才可能順利跟業者打官司。

衛生福利部昨天開會研商，追討大統、富味鄉的不法所得，建議裁罰逾23億元，如果有新事證，還可能再提高金額。但即使衛生局開出罰單，這筆罰款能否實際繳入國庫，還有變數。

因為業者依法有權利提出訴願，還可以打行政訴訟。葉彥伯說，到時與業者上法院打官司，需要提出的事證、資料繁雜，地方衛生局之前沒有處理天價罰款的經驗，可能需要中央成立專案小組協助。
