吸毒吸到掛  保險不理賠

【劉志原╱台北報導】蕭姓男子2011年間死亡，檢察官與法醫驗屍後，判定是「意外死」，蕭父在兒子生前，已為他向南山壽險投保200萬元意外傷害險，蕭父要求理賠，台北地院認為，驗屍報告中也寫明蕭男是甲基安非他命中毒，因吸毒屬犯罪行為，判南山免理賠；仍可上訴。

判決指出，驗屍證明書「死亡方式」選項有病死、自然死、意外、自殺、他殺、不詳等5種，蕭男因施用毒品過量中毒休克因而致死，並非病死或自然死或不詳，也不是自殺或他殺，僅能勾選意外死。至於「死亡原因」則是為中毒性休克。

法官認為「意外身故」是指外來性、偶然性而不可預見情形，但蕭男是吸毒而亡，並非意外身故，雙方合約已明定若因被保險人自身犯罪行為或故意行為而死亡，保險公司不予理賠，判南山免賠。
