影片中若有廣播或電視播放的音樂或畫面，是否侵犯著作權?

您好!
依著作權法規定，重製指以印刷、複印、錄音、錄影、攝影、筆錄或其他方法直接、間接、永久或暫時的重複製作，因此於影片中播放收音機或電視機的音樂或畫面，如該音樂或畫面屬於著作權法保護的著作，就涉及音樂或畫面重製的行為。除符合著作權法的合理使用規定的情形外，應徵得著作財產權人同意，始得於影片中利用。
原則上，拍攝影片過程中難免會發生重製美術著作的情形（例如鏡頭掃到掛在牆壁上的圖畫），依以上說明，確屬著作權法所稱的「重製」行為，但此種重製行為，如果利用程度輕微（所謂附帶重製），可認為屬於著作權法第六十五條所定的「合理使用」。（§3Ⅰ-5、§44～§65）(以上參考智慧局網站)
