車牌脫漆遭警開單　法官：應非故意免罰

【蔡進男／基隆報導】基隆市謝姓男子機車牌照脫漆，被警方依「塗抹污損汽車牌照不能辨識號牌」開罰3000元，謝男不服提行政訴訟，表示基隆、台北多雨，風吹日曬才會造成號碼掉漆，況且10天前被測速器拍到超速，還是同樣收到罰單；法官認為只有2個號碼均勻脫漆，車牌並無刮痕或塗抹噴漆情況，無法舉證是謝男是為了逃避取締才故意將漆刮落，且該機車已有11年車齡，不無可能脫漆，判決原處分撤銷。
