殺警判免死　家屬潑漆洩憤不起訴

【呂志明／台北報導】毒販李得陽16年前奪槍殺警林安順，被依殺人罪判無期徒刑定讞。林的外甥賴大為不滿李未判死，到最高法院潑紅漆怒嗆：「這些漆代表林安順的鮮血！法官對全國外勤警察開了一槍！」被依妨害公務罪送辦，但北檢認定賴僅發洩情緒，今將他不起訴。

1997年李得陽和同夥陳達民在新北市中和區遭警察盤查，2人因持有槍彈、毒品怕被抓，發狠開車衝撞警車，警察開槍打爆2嫌車子輪胎導致翻車後，雙方激烈槍戰，警員許振發頭部被陳男擊中，陳男也因腿部中彈倒地。

此時，小隊長林安順撲上去與陳男扭打，李得陽撿起掉在地上的警槍，對林安順的胸、腹連開兩槍斃命，警員許振發送醫則傷重癱瘓。陳男重創許振發部分，已依殺人未遂罪判無期徒刑定讞。法院原本也認定陳男擊斃林安順判無期徒刑，不料最高法院依現場圖及彈道比對，認定真兇應是李得陽並裁定再審。

去年8月最高法院認定李得陽開槍後沒察看同夥狀況就逃逸，顯然開槍目的只為躲避追捕，並非預謀殺警，不算罪大惡極，依殺人罪判無期徒刑定讞。
